By using this website, you agree to the following terms and conditions.
  1. The Derbyshire SEND Local Offer is a free and impartial service provided by Derbyshire County Council (the "Council").  The information contained within the Local Offer website (the "Site") is for the purposes of identifying to anyone accessing the Site (the "Users") the availability of such services, providers and related advice to children and young people with special educational needs and/or disabilities, and their families.
  2. Any posting by Users within the Site or otherwise (including any reviews, questions, photographs, videos, comments, suggestions, ideas or similar contained in any submissions, collectively, the "Content"), does not in any way represent or imply a recommendation or endorsement of any service or provider by the Council.  Users of the Site are responsible themselves for ensuring that such services or providers are suited to their needs.
  3. The Council do not edit or control the Content posted to or distributed on the Site by Users and the Council will not, in any way, be responsible or liable for such Content. The Council does, however, reserve the right for any reason in its sole and absolute discretion to remove any Content on the Site without notice.
  4. The Content published on the Site may include inaccuracies or errors. Whilst the Council aims to ensure that the information on services and providers on the Site is as accurate as possible, it is the responsibility of the relevant service or provider to keep the Council informed of any changes to their service or provisions. The Council, therefore, do not guarantee the accuracy of, and disclaims all liability for any errors or other inaccuracies relating to the information on the Site in any form, including the Content.
  5. The Council make no representations of any kind about the suitability of the services or providers offered on the Site for any purpose. The inclusion of any services or providers on the Site does not constitute any endorsement or recommendation of such services or providers by the Council. All such services and providers are provided "as is" without warranty of any kind.
  6. Users shall use the Site at their own risk and in no event shall the Council be liable for any direct, indirect, or consequential losses or damages or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption of any type arising out of, or in any way connected with a Users' access to, display of, or use of the Site, whether any claims arise through negligence, contract, tort, or otherwise, and even if the Council has been advised of the possibility of such claims or damages.
  7. Use of the Site by any User is subject to the acceptance of these terms and conditions. Users are not authorised to use the Site if they do not accept these terms and conditions.
  8. These terms and conditions, and any issues or disputes arising out of or in connection with them (whether such disputes are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation, or otherwise) shall be governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the Courts of England and Wales with regard to any such issues or disputes.
